Grandparents' Visitation Rights In New Hampshire, grandparents rights are not absolute, and are available to natural or adoptive Grandparents in limited circumstances. Grandparents may petition the court for reasonable rights of visitation with the minor child where some event has caused the absence of the nuclear family, such as divorce, death, relinquishment or termination of parental rights. When making an order relative to a grandparent's visitation rights to the minor child, the court determines the nature of the relationship between the grandparent and the minor child, the relationship between the grantparent and parent, whether visitation would interfere with any parent-child relationship, whether visitation is in the best interest of the child, the circumstances which resulted in the absence of the nucleur family, recommendations of a GAL, and the wishes of the child. The court may also take into consideration any other factors that the court deems relevant. If you are a grandparent and wish to obtain a court order for visitation with your grandchild(ren), contact us to find out if you may have a claim to seek visitation rights through the court.
