GUARDIANSHIP OVER MINOR PERSON AND/OR ESTATE There are some instances where it may be necessary to obtain guardianship over a minor child, if the guardianship will secure stability and security for the minor child and is in the child's best interests. New Hampshire law promotes the minor staying in their own home unless the court finds it is in the best interest of the child to substitue or supplement parental care and supervision. A Guardian over a minor grants the guardian the duty and authority to make important decisions in matters having a permanent effect on he minor. Guardianship over a minor child automatically terminates when the child reaches 18 years of age. Guardianship over an estate grants the guardian the duty and authority to handle the estate (assets) of a minor child. This is most often the case when a child is the beneficiary of a court settlement or a beneficiary in life insurance policy or estate of a deceadent.
Both guardians over a mino and guardians over an estate are required to file periodic reports to the Probate court and to act in a fiduciary manner.
