Frequently Asked Questions

HOW MUCH DOES IT COST TO HIRE YOU TO REPRESENT ME IN MY DIVORCE?

THE ANSWER IS IT DEPENDS....YOUR CASE IS UNIQUE AND THE FINAL COST OF REPRESENTATION DEPENDS ON WHAT YOU WISH TO ACHIEVE AND HOW CONTESTED THE CASE BECOMES.  ONE WAY WE HELP YOU, IS BY DOING WHAT WE CAN TO VALUE BILL, AND OFFSETTING THE COSTS OF LITIGATION BY HAVING YOU, THE CLIENT, DO SOME OF THE LEGWORK AND GATHER INFORMATION AND DOCUMENTATION SO YOU DON'T HAVE TO PAY US TO DO SO.

DO I NEED AN ATTORNEY ?

ALTHOUGH THE NEW HAMPSHIRE COURTS ARE BETTER THAN MOST COURT SYSTEMS FOR THE PRO SE (SELF REPRESENTING) PARTY, PRO SE PARTIES OFTEN FIND THEMSELVES BACK IN COURT TO CORRECT ISSUES THAT WERE NOT ADDRESSED IN THE ORIGINAL ACTION.  HAVING TO BRING A CASE BACK TO COURT IN MOST CASES WINDS UP TAKING MUCH LONGER AND COSTING BOTH PARTIES SUBSTANTIALLY MORE LEGAL FEES THAN THEY SAVED BY NOT BEING REPRESENTED IN THE ORIGINAL CASE.

HOW MUCH CHILD SUPPORT WILL I PAY/RECEIVE?

NEW HAMPSHIRE CHILD SUPPORT IS CALCULATED BY STATUTE, ALTHOUGH IN SOME CIRCUMSTANCES GIVE THE COURT THE AUTHORITY TO DEVIATE FROM THE GUIDELINES.  CHECK OUT OUR LINKS PAGE FOR THE CHILD SUPPORT GUIDELINES WORKSHEET TO ESTIMATE THE AMOUNT OF SUPPORT THAT WILL BE ORDERED BY THE COURT.

WHY DOES THE COURT APPOINT A GUARDIAN AD LITEM (GAL) ?

THE COURT APPOINTS A GAL TO CONDUCT AN INVESTIGATION, AND FILE A REPORT WITH A RECOMMENDATION BASED ON THE BEST INTERESTS OF THE CHILD(REN).  IN COMPLETING HIS/HER INVESTIGATION, THE GAL WILL LIKELY MEET BOTH PARTIES, THE CHILDREN, TALK TO REFERENCES PROVIDED BY BOTH PARTIES, REVIEW THE FILINGS OF THE PARTIES, THE GAL CAN SPEAK WITH MEDICAL CARE PROFESSIONALS, TEACHERS, DAYCARE WORKERS, COUNSELLORS, AND ANY OTHER PERSON WHO MAY HAVE INFORMATION THAT WILL HELP THE GAL MAKE A RECOMMENDATION TO THE COURT.  THE COURT ULTIMATELY MAKES THE DECISION, BUT THE GAL'S RECOMMENATION IS ONE OF THE FACTORS IN MAKING THAT DECISION AND THE COURT DETERMINES HOW MUCH WEIGHT IT PLACES ON THAT REPORT.
