Property Division

If you are facing a divorce, it is extremely important to consider how the dissolution of your marriage will affect your financial situation later on.  We work diligently and develop solutions for a fair division of our clients'' marital assets so they can move forward with their lives.

Marital Property includes all tangible and intangible property and assets, real or personal, belonging to either or both parties, no matter whose name the property is titled in.  New Hampshire presumes a 50/50 split of assets is equitable unless the court decides that an equal division would not be appropriate or equitable after considering one or more of the following factors:

  • Duration of marriage
  • Age, health, and occupation of the parties
  • Amount and sources of income
  • Vocational skills and employability
  • Estate and needs of each party
  • Opportunity for each party to acquire future capital assets and income
  • Which party contributed to the acquisition, preservation, or appreciation of assets and the value of the assets involved
  • Ability of the custodial parent to engage in gainful employment without substantially interfering with the interests of any minor children.
  • Need of the custodial parent to occupy or own the marital residence and to use or own its household effects.
  • The actions of either party during the marriage which contributed to the growth or diminution in value of property owned by either or both of the parties.
  • The value of any property acquired by gift, devise, or descent.
  • Any other factor that the court deems relevant.

Our office will gather all of the documentation that relates to the value of marital assets, including bank statements, 401Ks, and pension plans. Sometimes it is necessary to hire experts, such as a certified real estate appraiser or actuary to determine the value of a pension or other retirement accounts. In every case, we are committed to protecting our clients' best interests and preparing them for a more financially secure future. If you are considering divorce, or if you have been served with divorce papers, contact us today. We will help you prepare for what lies ahead and work relentlessly for the fair division of property in your divorce.
